1. Acceptance of terms
These Terms & Conditions ("Terms") govern your access to and use of the website located at winthropp.com (the "Site"), operated by Winthropp LLC ("Winthropp," "we," "us," or "our"). By accessing the Site or enrolling in any communications program described below, you agree to be bound by these Terms. If you do not agree, please do not use the Site or enroll in our SMS program.
2. SMS / text messaging program
Winthropp may offer an SMS text messaging program for transactional and account related notifications, such as account updates, confirmations, and service alerts ("Program"). The Program does not include marketing or promotional messages unless you are separately notified and asked to opt in to that category.
- Consent. By providing your mobile number and opting in, you consent to receive automated and non-automated text messages from Winthropp related to your account. Consent to receive messages is not a condition of any purchase.
- Message frequency. Message frequency varies depending on your account activity and interactions with us.
- Message and data rates. Message and data rates may apply, based on your mobile carrier plan.
- Opt-out. You may opt out of the Program at any time by replying STOP to any message. You will receive a one-time confirmation that you have been unsubscribed, and no further messages will be sent unless you opt in again.
- Help. Reply HELP to any message for assistance, or contact us at info@winthropp.com.
- Carriers. Carriers are not liable for delayed or undelivered messages. Not all mobile devices or carriers are supported.
- Supported carriers. The Program is available on major U.S. mobile carriers.
For information on how we collect, use, and protect the data associated with the Program, see our Privacy Statement. Text messaging originator opt-in data and consent will not be shared with third parties for marketing purposes.
3. Use of the Site
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Site by any third party.
4. Intellectual property
All content on the Site, including text, graphics, logos, and the Winthropp mark, is the property of Winthropp LLC or its licensors and is protected by applicable intellectual property laws. No content may be reproduced without prior written consent.
5. Disclaimer of warranties
The Site and any communications, including those sent through the Program, are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
6. Limitation of liability
To the fullest extent permitted by law, Winthropp LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or the Program.
7. Changes to these terms
We may update these Terms from time to time. Continued use of the Site or continued enrollment in the Program after changes take effect constitutes acceptance of the revised Terms.
